Introduction

At Getfly CRM, we are committed to protecting and respecting your privacy. This Privacy Policy outlines how we collect, use, and safeguard users' personal data when they interact with our services via our primary website (https://getfly.vn/), affiliated websites, downloadable applications, and mobile apps (including tablet apps). We ensure compliance with applicable laws, specifically Decree No. 13/2023/ND-CP on the Protection of Personal Data (“Decree 13”)  and its amendments.

This Privacy Policy forms an integral part of Getfly CRM's Terms of Service. Please read this policy carefully to understand our commitment to protecting your rights as a user.

ARTICLE 1. DEFINITIONS

In this Privacy Policy, the following terms are defined as:

1.1. Getfly CRM or we/us refers to Getfly Vietnam Technology Joint Stock Company, Enterprise Registration No. 0108107661, engaged in the business of providing customer relationship management (CRM) software services.

1.2. Customer refers to any individual, organization, or legal entity that uses Getfly CRM software via a legally executed contract.

1.3. User refers to individuals who directly access or interact with the Getfly system by logging in with credentials granted, assigned, or authorized by the Customer.

1.4. Service refers to Getfly's offering that helps customers operate and manage internal processes through:

  • Getfly's website at: https://getfly.vn/ and affiliated domains;
  • Downloadable applications and mobile apps (including tablet versions);
  • Other services provided by Getfly CRM.

1.5. Customer Data includes data, reports, addresses, folders, and documents stored electronically by the Customer or User via Getfly CRM's Services.

1.6. Personal Data means any information linked to or identifying a specific individual. It includes both basic and sensitive personal data as defined under Clauses 3 and 4, Article 2 of Decree 13.

1.7. IP Address refers to a unique identifier assigned to electronic devices used for identification and communication via the Internet.

1.8. Cookie are identifiers sent to users' computers or mobile devices that help recognize them and inform Getfly CRM when the Service or websites are accessed.

1.9. Server is a system (hardware and software) connected to the Internet that processes and responds to access requests from other computers.

1.10. Data Encryption is the application of methods, algorithms, or technical solutions to convert readable data into unreadable formats.

1.11. Access Control is the process of managing and restricting access to sensitive data to prevent unauthorized access, modification, or deletion.

1.12. Unauthorized Access refers to using unapproved systems (e.g., software, scripts, automated tools, browsers with scraping plugins, etc.) to access or retrieve data.

ARTICLE 2. DATA WE COLLECT

In the course of delivering our services, Getfly CRM and its partners may collect and process personal data (including but not limited to collection, recording, analysis, verification, storage, editing, publishing, merging, accessing, retrieving, revoking, encrypting, decrypting, copying, sharing, transferring, providing, deleting, or destroying personal data) to enhance the user experience.

We collect personal information when users:
- Register an account;
- Use our services;
- Interact with our website or applications.
According to Decree 13, personal data is classified into two types:

2.1. Basic Personal Data

Depending on the contracting party (individual, organization, legal entity), we may request:

  • Full name (and alias, if any)
  • Date of birth
  • Gender
  • Nationality
  • Email address
  • Phone number
  • IP address and device information
  • Service usage information
  • Other general data

Users may also voluntarily share or edit personal data on our platform at any time.

2.2. Sensitive Personal Data

Although we do not actively request sensitive data, we may collect it with user consent, including:

  • System account details: login credentials, company information, etc,…
  • Service-related data: payment info, transaction history, interaction records, etc,…
  • Other sensitive data as defined by law, requiring advanced security measures.

We ensure that sensitive personal data is not accessed or disclosed to third parties beyond our technical capabilities.

ARTICLE 3. METHODS OF DATA COLLECTION, STORAGE, AND PROCESSING

3.1. Data Collection Methods

Personal data may be collected via:

  • Contact/support forms.

  • Communication via email, phone, or support channels.

  • Account ownership transfer to another unit.

  • Stored for as long as necessary to fulfill the purpose, unless otherwise required by law.
  • Encryption and strict access control to prevent unauthorized access.

3.3. Data Processing

  • Data is processed only for the purposes listed in Article 4.
  • We implement safeguards to prevent misuse or unauthorized access.
  • Data is only processed with clear user consent or legal basis.
  • Processing may be manual, automated (via digital means), or legally approved alternative methods.

ARTICLE 4. PURPOSE OF DATA USAGE

Personal data provided by users is used for:

  • Communicating for support or inquiry resolution.
  • Sending newsletters, notifications, or promotions.

5.2. Users are responsible for

  • Notifying Getfly CRM promptly of any unauthorized access or suspicious activities related to their accounts.

ARTICLE 6. SHARING PERSONAL INFORMATION

We commit not to share users’ personal information with third parties without the user’s clear consent, unless required by law or under the following circumstances:

  • When required to comply with legal obligations, investigations, or reporting duties stipulated by competent governmental authorities.
  • When necessary to share information with partners, service providers, or relevant parties to perform transactions or support customer service.

Getfly requires all involved third parties to adhere to strict data protection standards when sharing information under the aforementioned circumstances.

ARTICLE 7. COMMITMENT TO DATA SECURITY

Getfly CRM applies stringent technical and organizational security measures to protect users’ personal information against unauthorized access, disclosure, alteration, or destruction. These measures include data encryption, firewall systems, and strict access controls.

We are proud to have achieved ISO/IEC 27001:2013 certification, an internationally recognized standard for information security management. This affirms Getfly CRM's commitment to maintaining information security and protecting user data.

Getfly CRM secures Customer personal data based on the registered information. Therefore, we are not responsible for any impact or limitation to the Customer’s benefits resulting from inaccurate information provided by the Customer.

ARTICLE 8. USE OF COOKIES AND TRACKING TECHNOLOGIES

We use cookies and other tracking technologies to enhance the user experience on Getfly CRM’s website and applications. Cookies help us analyze service usage and optimize platform features.

Users can customize cookie settings through their browsers. However, disabling cookies may affect some functionalities of the website.

ARTICLE 9. INCIDENTS AND POTENTIAL RISKS

Getfly CRM employs multiple information security technologies to protect users' personal data and is committed to safeguarding Customer data to the fullest extent allowed by law.

Nonetheless, unforeseen incidents and risks may still occur, including but not limited to:

  • Hardware or software malfunctions during data processing that result in data loss.
  • Security breaches beyond Getfly CRM’s control, such as hacker attacks causing data leakage.
  • Customers inadvertently exposing their personal data due to negligence, fraud, or accessing malicious websites or applications…

In such cases, Getfly CRM will promptly notify users and relevant authorities in accordance with Decree 13. We will assess the impact and provide users with guidance on mitigation steps, and report to competent state agencies as required.

Getfly CRM advises users to proactively secure login credentials, OTP codes, biometric data, and avoid sharing such information with others.

ARTICLE 10. DISCLAIMER OF LIABILITY

10.1. Within the scope of this Privacy Policy, Customers and/or Users acknowledge that they have been adequately informed of: (i) the types of personal data collected and processed, (ii) the purposes of such processing, (iii) the individuals or organizations involved in processing the data, and (iv) their rights and responsibilities.

Customers and/or Users agree that Getfly CRM has the right to collect and process such personal data for the stated purposes and accept any relevant exceptions noted herein.

Customers and/or Users acknowledge that Getfly CRM may share, disclose, or transmit personal information to third parties as stipulated in Article 6 of this Privacy Policy.

10.2. Getfly CRM will adopt reasonable security measures to protect users’ personal data in accordance with applicable laws. However, we cannot foresee or prevent all risks, including unauthorized access due to hacking, intentional disclosure, malware injection, and similar threats. In such cases, Getfly CRM disclaims all legal responsibility related to maintaining information security.

10.3. Getfly CRM will not be held legally liable, including for civil or criminal responsibilities or damages, if Customer and/or User data is leaked due to unforeseen incidents or the user’s own disclosure. If Getfly CRM is proven to have violated this Privacy Policy and agrees to pay damages, the compensation shall not exceed the total service fees paid by the Customer within the one (01) year preceding the incident.

10.4. If the Customer discontinues the use of Getfly CRM's services or if access rights expire or are terminated, Getfly CRM may continue storing, using, and/or disclosing Customer personal data in accordance with this Privacy Policy and legal obligations.

10.5. The Customer agrees that, subject to applicable laws, Getfly may securely delete personal data without prior notice.

10.6. The Customer and/or User agrees to waive any right to lodge complaints, initiate lawsuits, or request intervention by competent authorities regarding the disclaimers stated herein.

10.7. If any provision of this Policy is declared invalid by a competent dispute resolution body, that provision shall be null and void without affecting the validity of the remaining terms, which shall remain fully enforceable.

ARTICLE 11. PRIVACY POLICY UPDATES

Getfly CRM may update this policy to reflect changes in how we collect, use, and safeguard personal information. Any changes will be posted on this privacy policy page and take effect immediately upon posting.
